$12.7 Million Estate Planning Equity Indexed Annuity Order

This month the King County Superior Court, State of Washington ordered CLA to pay $6.2 Million in restitution and $6.5 Million in civil penalties and issued injunctive relief in a case arising out of fraudulent free "estate planning" seminars used in part to gather information from unsophisticated seniors in Washington. 11th Circuit Affirms District Court Order Confirming $3.4 Million Puerto Rico Award

In December 2020, the US Court of Appeals for the 11th Circuit affirmed the April 2020 US District Court for the Southern District of Florida Order confirming an arbitration award against Morgan Stanley over Puerto Rico municipal bonds. Previously in July 2019, a FINRA panel in Miami, FL ordered Morgan Stanley to pay $3,231,421 including $3 Million in monetary sanctions for discovery abuse. You can read that award on our website. 4th Circuit Court Reinstates $1.5 Million VXX Arbitration Award Against Interactive Brokers

In August 2020, the US 4th Circuit Court of Appeals reversed the US District Court for the Eastern District of Virginia's Order vacating and remanding for hearing before a new arbitration panel a modified arbitration award against Interactive Brokers. Previously in January 2018, a FINRA panel in Richmond, VA ordered Interactive Brokers to pay at least $1,544,843 in compensatory damages and attorneys' fees. Dr. McCann testified on liability and damages over Interactive Broker's application of portfolio margin rules to a portfolio of VXX ETNs and options on VXX ETNs.

10th Circuit Upholds District Court Order Confirming $1 Million Arbitration Award

In April 2020, the US 10th Circuit Court of Appeals upheld the US District Court for the District of Colorado's March 2018 Order confirming an arbitration award against Mid Atlantic. Previously in December 2016, a FINRA panel in Denver, CO ordered Mid Atlantic to pay at least $1,037,000 including $3 Million in monetary sanctions for discovery abuse. You can read that award on our website. Dr. McCann testified on liability and damages over Mid Atlantic's sale of a non-traded KBS REIT and illiquid loan fund, Sonoma Ridge Partners.

$750,000 Burch v Huntleigh Securities Corporation Option Award.

In March 2020, a FINRA arbitration panel in St. Louis, MO ordered Huntleigh Securities Corporation to pay the Claimant $750,000 including $200,000 in punitive damages and $250,000 in attorney's fees. Dr. McCann testified that the securities portfolio was poorly diversified and the heavy use of short call options in the portfolio substantially increased the risk beyond what was appropriate for the Claimant.

$455,000 Abdallah v FMSBonds Puerto Rico Bond Award

In January 2020, a FINRA arbitration panel in Boston, MA ordered FMSBonds to pay $455,000 including $80,000 in attorneys' fees. Dr. McCann testified on liability and damages over Puerto Rico municipal bonds.

$2 Million Pagan v Merrill Lynch Puerto Rico Award

In January 2020, a FINRA arbitration panel in San Juan, PR ordered Merrill Lynch to pay Claimants at least $2,022,071 in compensatory damages, interest and costs including expert costs. Dr. O'Neal testified on liability and damages over Merrill Lynch's sale of UBS Puerto Rico municipal closed end bond funds and Puerto Rican municipal bonds.

In January 2020, a FINRA panel in St. Louis, MO ordered National Planning Corporation to pay $2,629,273 in well managed account damages, punitive damages and costs. Dr. McCann testified on liability and damages over NPC's sale of non-traded REITs and variable annuities.
